Draft. Some of our policies have not been settled yet, including our returns policy, our delivery area and the terms that apply to wholesale orders. Those sections below are deliberately incomplete rather than guessed at. This page should not be treated as final, or relied on as a statement of our policies, until every one of them is resolved and this notice is removed. If you need an answer on any of them before then, please contact us and we will tell you where we stand.
1. Accepting these terms
These terms apply when you browse eatlilyas.com, place an order, create an account, subscribe to our emails, or use the wholesale portal. By doing any of those things you agree to them. If you do not agree, please do not use the site.
You need to be at least 18 years old, or have a parent or guardian do it for you, to place an order or open an account. Wholesale accounts are for businesses, and by applying for one you confirm you are authorised to act for the business you name.
2. Who runs this store
Lilya’s by Cybel is the packaged tea and food brand of the Cybel family of businesses in St. Petersburg, Florida, the same kitchen behind Cybel French Moroccan Fusion and Lilya’s Café.

“We”, “us” and “our” below mean that business. “You” means the person or business using the site.
3. How this store is put together
This is worth understanding before the rest of these terms make sense, because two companies are involved in every order.
The pages you are reading are ours. The commerce behind them runs on Shopify. Our product catalogue, your cart, your customer account and the checkout itself all live in Shopify. When you press Checkout, you leave this site and finish your purchase on Shopify’s hosted checkout.
This means we never see or store your card details. Payment information is entered on Shopify’s checkout and handled by Shopify and its payment processors under their own security standards and terms. No part of this website receives a card number. Your use of the checkout is also subject to Shopify’s terms of service and privacy policy alongside ours.
What we handle directly on this site is your cart before checkout, the wholesale sign in, the wholesale application form, and newsletter signups. How we treat that information is described in our Privacy Policy.
4. Accounts
You can shop as a guest. Accounts exist for two reasons: wholesale access, and our mailing list.
Subscribing to our emails creates an account. Because of how our store is connected to Shopify, a newsletter signup creates a customer record with a randomly generated password that is never shown to anyone and never sent to you. We are telling you this because it has one practical effect: if you subscribe and later try to register with the same email address, you may be told it is already taken. If that happens, use the password reset flow or contact us and we will sort it out.
If you do hold an account with a password you chose, keep it to yourself. You are responsible for activity under your account. Tell us promptly if you think someone else has access to it.
Give us accurate information, and keep your delivery address and contact details current. We may suspend or close an account that is being used to break these terms, or that we reasonably believe is fraudulent.
5. Orders, prices and payment
Adding something to your cart does not reserve it. Your order becomes an order when you complete checkout, and we accept it when we confirm it or ship it, whichever comes first.
- Prices are in US dollars and do not include tax or delivery unless the checkout says so. Applicable sales tax and delivery charges are calculated and shown at checkout before you pay.
- Prices, products and availability can change at any time. A product may sell out between you adding it to your cart and reaching checkout.
- We try hard to describe and photograph our products accurately, but screens vary and packaging changes. The label on the bottle is the authority on what is in it.
- If a product is listed at an obviously wrong price because of an error on our side or Shopify’s, we may cancel the order and refund you in full rather than fulfil it. We will tell you if that happens.
- We may decline or cancel an order, including for suspected fraud, resale of retail stock, or a quantity we cannot fulfil.
Payment is taken at Shopify’s checkout, by the method you choose there, at the time you place the order.
6. Delivery
Our drinks are fresh, perishable products, which shapes everything about how we get them to you. Refrigerate them on arrival, keep unopened bottles until the best by date printed on the label, and finish an opened bottle within a few days. Storage guidance is on each product page.
Delivery timescales given at checkout or on a product page are estimates, not guarantees. We are not responsible for a delay caused by something outside our reasonable control, including weather, a carrier’s failure, or an address that turns out to be wrong or inaccessible. If nobody is there to receive a chilled delivery, we cannot guarantee its condition afterwards.
Risk of loss passes to you on delivery. If something arrives damaged, see the next section.
7. Returns, refunds and damaged orders
Our returns and refunds policy is one of the items still being settled, so this section does not yet state a fixed window or process.
In the meantime, if anything about your order is not right, please contact us with your order number and a photograph if the packaging or product was damaged, and we will deal with it individually.
Note for context rather than as a policy: food and drink is generally exempt from any cooling off or change of mind right once it has been delivered, for food safety reasons. Nothing here affects any right you have under Florida or federal consumer law that cannot be waived.
8. Wholesale accounts
The wholesale portal is for businesses stocking or serving our products, such as cafés, markets, shops, gyms and offices. It is not open to individuals buying for themselves.
Applying. The application asks for your name, email, phone number, business name, business type, tax identification number and business address, and creates a customer account with a password you choose. We use the tax identification number to verify that you are a legitimate business and, where relevant, your tax exempt or resale status. You confirm the information you give us is true.
Approval is not automatic. Creating the account does not give you wholesale access. Access is granted by us by hand after we review the application, which typically takes one to two business days. Until then, signing in will tell you the account is not yet approved. We may decline an application without giving a reason.
Partner pricing. Once approved, your discount is applied automatically at checkout. Wholesale prices are commercially confidential between us and you: please do not publish them or share them with other stockists. Wholesale stock is for resale or service in your business, not for personal use and not for resale through online marketplaces without our agreement.
Delivery windows. Wholesale orders are delivered locally on the dates offered in the portal calendar. Deliveries run on Tuesdays and Fridays, and an order must be placed at least two full days before the delivery date you choose. Dates that do not meet those rules are not selectable.
Ending access. We may suspend or withdraw wholesale access, including where an account is inactive, where information given on the application turns out to be wrong, where an invoice goes unpaid, or where these terms are broken. Withdrawing access does not by itself cancel an order already accepted.
Some wholesale terms are still being settled, including minimum order size, payment terms and notice for changing an order. We will agree those with you directly when your account is approved, and they will be stated here once they are fixed.
9. Emails from us
Subscribing to our list means we may send you news, new releases and offers. Every marketing email has an unsubscribe link and you can use it at any time. We will still send you the transactional emails that go with an order, such as the confirmation and delivery updates, because those are part of the purchase rather than marketing.
10. How you may use the site
You agree not to:
- place an order using someone else’s payment method or identity, or give false information at checkout or on a wholesale application;
- buy retail stock with the intention of reselling it as if it were a wholesale supply;
- attempt to access an account, order or area of the site that is not yours, including the wholesale portal without approval;
- scrape, harvest or systematically copy our catalogue, pricing, photography or content, or run automated tools against the site in a way that degrades it for other people;
- upload or transmit anything harmful, probe our infrastructure, or interfere with how the site or the checkout works;
- use the site in a way that breaks any applicable law.
We may suspend access, cancel orders or close accounts where any of this happens.
11. Content and intellectual property
The Lilya’s name, the Lilya’s by Cybel name, our bottle labels and packaging design, our photography, our written content and the design of this site belong to us or to the people who created them for us, and are protected by copyright and trade mark law.
You may view the site, save or print a page for your own use, and link to us. Approved stockists and wholesale partners may use our product photography and brand name to sell the products they have bought from us, in the ordinary way, and should not alter our logo or imply a partnership beyond that. Anyone else needs our written permission before using our brand assets commercially.
If you post a review, photograph or comment through the site or tag us publicly, you keep ownership of it, and you give us permission to reshare it with credit across our own channels. You confirm it is yours to share.
If you believe something on this site infringes your copyright, contact us with enough detail to identify the work and the page, and we will look into it.
12. Third party services and links
As well as Shopify, this site uses analytics to understand how the store is used, which only runs if you agree to it in the cookie banner. We link to stockists, partners and our social accounts. We are not responsible for other companies’ content, products, opening hours or handling of your information. Details of what we set and why are in our Privacy Policy.
13. Disclaimers
We provide this website “as is”. We do not promise it will always be available or free of errors, and stock levels, stockist listings and delivery estimates can be out of date at the moment you read them.
Nothing on this site is medical, dietary or nutritional advice, and our drinks are not intended to diagnose, treat, cure or prevent any condition. They are food and drink. Read the label before drinking, particularly if you have an allergy, are pregnant, or are managing a condition affected by what you consume, and speak to your own clinician rather than relying on anything written here. Our products are made in a kitchen that handles common allergens, so we cannot guarantee any product is free of a given allergen beyond what the label states.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses arising from your use of this website or from a delay in delivery, including lost profit or lost business.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for any liability relating to the safety of food we supply, or for anything else that the law does not permit us to exclude.
15. Your responsibility to us
If you break these terms and that causes us a loss, for example a claim brought against us because of how you resold our product or what you said about it, you agree to cover the reasonable costs we incur as a result.
16. Governing law
These terms, and any dispute arising from them, from an order, or from your use of this site, are governed by the laws of the State of Florida, without regard to its conflict of laws rules.
17. Changes to these terms
We may update these terms as the business and the store change. The current version is always the one on this page, and the date at the top tells you when it last changed. The terms that apply to an order are the ones published when you placed it. Continuing to use the site after an update means you accept the updated terms.
